Terms and Conditions
1. Contractual Relationship
These Terms of Use ("Terms") govern your access to and use of the Secure Cab mobile applications, websites, content, products, and services (the "Services") provided by Secure Cab
(Pty) Ltd, a private limited liability company incorporated under the laws of South Africa ("Secure Cab").
PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.
Your access and use of the Services constitute your agreement to be bound by these Terms, which establish a contractual relationship between you and Secure Cab. If you do not agree to these Terms, you may not access or use the Services.
These Terms expressly supersede prior agreements or arrangements with you. Secure Cab may terminate these Terms or any Services at any time.
Supplemental terms may apply to specific Services (e.g., promotions or events). Supplemental terms shall prevail in the event of conflict.
Secure Cab may amend these Terms from time to time. Updated Terms will be effective upon posting. Continued use of the Services constitutes acceptance of amendments.
Secure Cab processes personal information in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA). Details are available in the Secure Cab Privacy Policy.
2. The Services
The Services provide a technology platform that enables users to arrange and schedule transportation services with independent third-party providers ("Drivers") under agreement with Secure Cab.
Secure Cab does not provide transportation services and is not a carrier. All transportation services are provided by independent third-party Drivers. Drivers are required to comply with the National Road Traffic Act 93 of 1996 and any municipal licensing requirements.
License: Secure Cab grants you a limited, non-exclusive, revocable, non-transferable license to access and use the Application on your personal device for the purpose of arranging transportation services.
Restrictions: You may not use the Services for unlawful purposes, decompile/reverse engineer, interfere with network security, transfer your account, or transport dangerous goods.
Third-Party Content: Secure Cab is not responsible for third-party services, advertising, or content.
Ownership: All intellectual property rights remain with Secure Cab or its licensors.
3. Your Use of the Services
User Accounts: You must be 18+, provide accurate details, and safeguard login info. Secure Cab may require proof of identity under FICA for fraud prevention.
4. Rider Responsibilities
- Lawful and Respectful Behavior: Riders must act respectfully.
- Compliance with Law: Riders must comply with traffic laws; seatbelt mandatory.
- Minimum Age: 18+ (minors must be accompanied).
- Prohibited Conduct: No harassment, fraud, or illegal activities.
- Identification: Secure Cab may request ID.
- Respect for Safety: Riders must follow driver safety instructions.
- Safety: No rides under influence of drugs/alcohol in a way that endangers driver.
- Property: Riders are responsible for belongings.
- Damage: Riders may be charged for repair/cleaning beyond normal use.
5. Driver Responsibilities
- Valid license, PrDP, insurance, and roadworthy vehicle required.
- Vehicles must be safe, clean, and compliant.
- Respectful conduct; no harassment or unsafe driving.
- No illegal activity or unlawful transport.
- Must follow Secure Cab vetting and compliance checks.
- Zero tolerance for alcohol/drug use while driving.
- Ensure passengers wear seatbelts and obey traffic laws.
6. Payment
Charges apply for transportation services. Secure Cab acts as collection agent. Charges may include tolls, surcharges, VAT, booking fees. Charges are final unless otherwise determined.
Secure Cab – Cancellation Policy:
- Rider Cancellations: No fee if cancelled before driver accepts.
- Standard & Executive: Fee applies if cancelled 5+ mins after booking.
- Premium: Fee applies if cancelled 5+ mins after booking.
- Shared: Fee applies if cancelled 2+ mins after booking.
- Driver No-Show Policy:
• Shared: 2 min wait
• Standard: 7 min wait
• Executive & Premium: 10 min wait
- Grace Periods: No fee if driver is 5+ mins late or moves away.
- Scheduled Trips: Free cancel up to 1 hour before pickup; otherwise cancellation fee applies.
Payment Methods: Debit/credit card, in-app wallet, EFT.
Repair/Cleaning: Riders may be charged for damage or excessive mess.
7. Disclaimers; Limitation of Liability; Indemnity
The Services are provided 'as is'.
No Guarantee: Secure Cab does not guarantee availability, timeliness, or error-free service. Third-Party Providers: Drivers may not be professionally licensed; Secure Cab is not liable for their conduct.
No Responsibility for Transportation: Secure Cab only provides the platform.
Limitation of Liability: Secure Cab not liable for indirect damages. Total liability capped at USD 500 (or ZAR equivalent). Consumer rights under CPA protected.
Indemnity: Users indemnify Secure Cab against claims, misuse, or legal violations.
8. Lost Property
Riders responsible for belongings. Secure Cab not liable. Lost items held for 3 months, thendisposed.
9. Termination
Secure Cab may suspend/terminate accounts for violations. Riders may terminate accounts via support or app.
10. Privacy and Data Protection
Secure Cab processes personal data under POPIA. Details in Privacy Policy.
11. Amendments to Terms
Secure Cab may amend these Terms; users will be notified of major changes. Continued use = acceptance.
12. Governing Law & Dispute Resolution
These Terms governed by South African law. Disputes go to mediation, then arbitration (AFSA, Johannesburg). Consumers may approach NCC under CPA.
13. Other Provisions
- Notices: Secure Cab may notify via app, SMS, or email.- Assignment: Users may not transfer rights; Secure Cab may assign
